“We” are Mac Media Law Limited, a company registered in Scotland (Number: SC737059).   Mac Media Law is a Scottish legal services practice, regulated by the Law Society of Scotland.   Our registered office and principal place of business is at 4 Elliot Avenue, G46 7NS.   Our VAT Registration Number is 420 677 014.  

These Terms incorporate our Privacy Policy.  When you use www.macmedialaw.com you agree to be bound by these Terms.

PRIVACY POLICY

This Privacy Policy outlines how Mac Media Law use, store and share any personal data obtained by or submitted to us where we act as ‘data controller’ under the Date Protection Act 2018.  We will process this personal data in accordance with data protection standards required by the applicable lawsand regulations.

The data controller is Mac Media Law Limited, a company registered in Scotland (Number: SC737059) and having its registered office 169 West George Street, Glasgow G2 2LB.  

Collection of personal data

Your personal data may be collected by us in a number of ways, including:

• through our provision of legal services to you;

• during the course of dealings with you for or on behalf of a client;

• when you provide us with information in relation to your attendance at any of our seminars or other hosted events; and/or

• when we collect it from third parties (for example our clients or other law firms)

What categories of personal data will we collect?

The categories of your personal data that we may collect include, but are not limited to, the following:

• personal contact details such as title, name, address, telephone number, email address, job title and name of employer

• employment information, where your employer is our client or a party providing information to our client

• information relating to the strength of your business relationship with us

• information to enable us to carry out legal and regulatory checks such as anti-money laundering checks

• business information necessary for our business relationship with you, including financial, banking and payment details

• information collected from publicly available sources such as Companies House, Registers of Scotland, the Land Registry, LinkedIn and any professional directories

• information from credit agencies

• information regarding any relevant investigations or legal proceedings

• information provided by you for the purpose of attending meetings and events, including records of your attendance at our offices held for security purposes

• information on your subscription preferences connected to this website

• contact and other information where you or your organisation is a supplier to Mac Media Law

How will we use your personal data?

We may process personal information about you for the following purposes:

to provide you or a client with our services

to verify source of funds and/or source of wealth

to deal with your enquiries and requests

to contact you in the course of providing services to our clients

Sharing with third parties

We may share your personal data with third parties where we are legally permitted to do so and where this is required for communicating with you or for providing our services to you.

When we share data with third parties we are obliged to implement appropriate technical and organisational measures to protect the personal data and to comply with the GDPR.

We may employ or engage other persons, companies or organisations to perform functions on our behalf.  This includes, but is not limited to, consultant solicitors, outsourced administrative and IT companies (including cloud-based software entities, website hosting and management companies and data analysis, back-up and security service providers).  Data will be shared with such third parties when this is required for us to fulfil your instructions or where it will be beneficial to your interests.  

In providing our services to you we may be required to share personal data if this is necessary under any law or regulation (eg for prevention of financial crime or terrorism), or if we think you, or others, could be at risk.  

We may also be required to pass your personal data to the following:

• accountants, auditors and other professional advisers

• property registrars

• HM Revenue & Customs

• court or tribunal

• opposing solicitors

• an advocate, senior advocate (KC) or barrister

• banks, building societies or other financial institutions

• insurance companies

Occasionally, we may receive requests from third parties with authority to obtain disclosure of personal data eg seeking to check that we are complying with applicable laws and regulations, to investigate an alleged crime and/or to establish, exercise or defend legal rights.   We will only fulfil requests for personal data where we are permitted to do so in accordance with applicable laws and regulations.

Personal data may be transferred beyond the countries where we and our clients are located, for example to cloud-based locations worldwide.  We will always take appropriate steps to try to ensure that all personal data transferred in this way is subject to adequate levels of protection and that all transfers of personal data outside the UK and Europe are done lawfully.  

Retention of personal data

We will retain personal data for as long as is necessary to meet the purposes set out in this Privacy Policy.  We will retain and use your information to the extent necessary to comply with our legal obligations, to resolve disputes and to enforce agreements.

Your rights

You have a right of access to your personal data which is held by us as a data controller.   This right may be exercised by emailing your access request to kirsteen@macmedialaw.com. We aim to respond to any requests for this informationpromptly, and in any event within 30 days.

To update, correct or rectify any personal data held by usplease email kirsteen@macmedialaw.com to provide details so that we can make the necessary amendments.

 

You have the right to ask us to cease processing your personal data and/or to erase any personal data that we hold.  We will comply with any such request but only to the extent that we are not required by law or regulation to retain your personal data.  To request cessation or erasure, please email kirsteen@macmedialaw.com.

 

You have the right to receive any personal data requested in a structured, commonly-used and machine-readable format.  You have the right to transmit that data to another controller without hindrance from us.  In addition such data may, at your request, be directly transmitted by us to another data controller.

 

 

 

Third-party personal data

If you provide us with any third-party personal data you must ensure that you have all necessary permissions from that third party.  We will assume that you have these permissions and shall then collect, use and share that data in accordance with this Privacy Policy.

Changes to this Privacy Policy

This Privacy Policy will be kept under regular review and therefore may change from time to time to ensure our continued compliance with all laws and regulations.  This Privacy Policy was last updated in September 2022.
